What to send

Email is fastest. To be actionable under 17 U.S.C. §512(c)(3), a notice needs six things, and a notice missing one of them is a notice we have to come back to you about:

  1. A signature — typed is fine — of the copyright owner, or of someone authorised to act for them.
  2. Identification of the copyrighted work you say was infringed.
  3. The URL of the page, plus enough detail to find the specific photograph or text on it. “A listing on your site” is not enough to act on; a link and a description is.
  4. How to reach you: name, mailing address, telephone number and email address.
  5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and — under penalty of perjury — that you are authorised to act on the owner’s behalf.

What happens next

A complete notice is acted on promptly: the material is removed or disabled, and whoever supplied it is told what came down and why.

Most photography on the search and listing pages comes from the MLS feed and belongs to the listing brokerage that supplied it, not to this site. Where that is the case the notice is forwarded to the MLS as well as acted on here, so the problem is fixed at the source rather than one website at a time.

If your material was removed by mistake

You can send a counter-notification under §512(g) to the same address. It needs:

  1. Your signature, name, mailing address and telephone number.
  2. Identification of the material that was removed, and the location it appeared at before it was removed.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of a mistake or a misidentification.
  4. Your consent to the jurisdiction of the Federal District Court for the district your address is in (or, if your address is outside the United States, any district in which the service provider may be found), and that you will accept service of process from the party who filed the notice.

Repeat infringers

Accounts and contributors who repeatedly infringe are terminated. That is a policy rather than a threat: the safe harbour this page relies on requires one, and a policy that is never enforced is not a policy.

Knowingly filing a false notice carries liability for damages under §512(f), including costs and legal fees. Please be sure before you send one.
